2.2 When Auxy AI Acts as Data Processor

We act as a Data Processor when providing services to business customers.

In this role:

  • Customers determine the purpose and nature of data processing

  • Auxy AI processes Customer End-User Data strictly under contractual instructions

  • Auxy AI does not use Customer Data for independent commercial purposes

Customer data processing is governed by applicable contractual agreements and data processing addendums.

3.2 Billing & Commercial Data

We do not store payment card details. Payment processing is handled by authorized providers.

When customers use our platform:

  • RCS communication data

Auxy AI does not review or control customer communication content except as required to provide the Service.

3.4 AI Processing Data

Where AI-powered features are enabled:

  • Customer content may be processed by Auxy AI’s proprietary AI systems

  • Certain features may involve authorized third-party AI providers as configured by the customer

Customer authorization governs such AI processing.

Auxy AI does not use customer data to train generalized foundation models unless explicitly agreed in writing.

  • Platform diagnostics

This data is used for security, analytics, and service improvement.

4. Messaging Infrastructure & Channel Operations

Auxy AI operates proprietary communication infrastructure including:

  • RCS messaging channels

Auxy AI is a recognized technical partner within Meta’s ecosystem for WhatsApp Business Platform services. Message delivery via Meta infrastructure is subject to Meta’s independent terms and policies.

Message transmission may involve telecom carriers and network providers subject to applicable regulatory frameworks.

5. Broadcasting & Customer Compliance Responsibility

Customers are solely responsible for:

  • Obtaining lawful and valid end-user consent

  • Complying with telecom, marketing, and data protection regulations

  • Ensuring lawful communication practices

Auxy AI does not assume responsibility for unlawful, unsolicited, or non-compliant communications initiated by customers.

6. Lawful Basis for Processing

Where applicable, we process personal data based on:

  • Contractual necessity

  • Legitimate business interests

  • Legal obligations

  • Consent (where required)

7. Data Retention

7.1 Customer Data

Customer communication data is retained:

  • For the duration of the contractual relationship

  • As configured by the customer

  • In accordance with contractual agreements

Upon termination, data is deleted in accordance with contractual obligations, subject to legal requirements.

7.2 Diagnostic & Security Logs

Auxy AI maintains limited diagnostic logs for:

Such logs are retained only for limited operational periods and are not used for profiling.
